Restrictive Covenant

A restrictive covenant comes from an agreement between the owners of two or more parcels of land or by the developer of a subdivision or condominium.  The purpose is to “restrict” certain things in the use and development of land.  A common restrictive covenant is to set architectural controls in a neighbourhood so that future improvements are consistent with the area.  A restrictive covenant is similar to a bylaw in that it is enforceable only upon registration at Land Titles, and it applies equally to all owners.
