Changes to the AREA Purchase Contracts (Residential, Country Residential and Condominium) will be published later this summer for AREA member use.

The Process for Purchase Contract Changes

Guiding Principles
The writing of new content for the Purchase Contract forms was guided by several key principles:

  • Ensuring the legal integrity of AREA Forms;
  • Creating balance between the seller and the buyer; and
  • Clarifying the forms content through clearer language.
To further guide AREA's work, research was done through:

  • Past versions of AREA Forms;
  • Forms from other jurisdictions;
  • Legal advice;
  • Legal cases and the Alberta Legal Practice Manual;
  • Plain language and legal texts;
  • Relevant legislation (e.g. Alberta's Real Estate Act); and
  • Education materials.

Who Contributed to the Project?
Stakeholders and stakeholder groups spanning the real estate industry were asked to contribute throughout the development of the new contracts. Those who contributed with ideas, advice and feedback included:

  • AREA members:
    • 879 responses to an AREA member survey on the Purchase Contract;
    • 23 Brokers and Associates providing advice and feedback;
    • Voting members of AREA's Forms & Practice Committee representing the first stage of the governance process; and
    • The AREA Board of Directors representing the final stage of the governance process.
